5th Circ. Waits On Bid To Certify Broker Question In Virus Suit

By Ben Zigterman (June 29, 2022, 4:22 PM EDT) — The Fifth Circuit will continue with oral arguments next week in a Louisiana jewelry store’s COVID-19 coverage appeal, saying Tuesday that it will wait to decide on the jewelry store’s bid to send a question about its broker’s obligations to the state’s top court.

A Fifth Circuit panel is scheduled to hear the appeal from New Orleans-based jeweler Coleman E. Adler & Sons on July 7. The jeweler is appealing the dismissal of its suit against Axis Surplus Insurance Co. and broker Risk Placement Services Inc.
